WEBSITE TERMS AND CONDITIONS
§1.
General provisions
- These Terms and Conditions set out the rules and technical conditions for the provision of services by electronic means through the website www.patt.pl in accordance with Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2020, item 344).
- From the moment of taking actions involving the use of the services of the Website, including browsing its content and using the functionality made available by the administrator, each User is required to comply with these Terms and Conditions.
- The Terms and Conditions in particular determine:
- types and scope of services provided electronically,
- the conditions under which services by electronic means may be provided,
- the conditions for the conclusion and termination of contracts for the provision of services by electronic means,
- the complaint procedure.
§2.
Definitions
- The terms used in these Terms and Conditions mean:
- Service Administrator or PATT MEBEL – Zbigniew Patejko “PATT Mebel” with registered office at 8 Tytoniowa Street, 04-228 Warsaw; REGON 012259935; NIP 534-00-18-651;
- Personal data – means information about an identified or identifiable natural person, in particular on the basis of an identifier such as name, identification number, location data, internet identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation);
- Website – the Internet service belonging to PATT Mebel and through which the Company provides its services. The service is available at http://www.patt.pl;
- User – a person using the Website in any way;
- Electronic Services – services provided electronically by PATT Mebel;
- Act on the Provision of Services by Electronic Means – the Act of 18 July 2002 on the Provision of Services by Electronic Means (Journal of Laws of 2020, item 344) (hereinafter referred to as: u.ś.u.d.e.);
- Terms and Conditions – this document defining the principles and technical conditions for the provision of services by electronic means, being at the same time the legal basis for using the Website.
§3.
Conditions for the provision of electronic services
- These Terms and Conditions determine the rules of providing services electronically by the Website Administrator.
- The proper display of the Website pages and use of electronic services provided by PATT Mebel via the website located at the following address: http://www.patt.pl is conditional on the system and software installed on the User’s computer meeting at least the following requirements:
- connection to the Internet,
- a browser that accepts cookies.
- the following versions of web browsers (or newer versions): Chrome 64, Firefox 59, Safari 11, iOS Safari 10.3, Internet Explorer 11, Microsoft Edge 16. as of 2019-07-10, in the future 2 versions back to the current one.
§4.
Conditions for the conclusion and termination of contracts for the provision of services by electronic means
- As soon as the user enters the appropriate Internet address in his browser, i.e. the page www.patt.pl chosen by him, the contract for the provision of information services by electronic means is concluded.
- Termination of the contract for the provision of information services by electronic means takes place at the moment of leaving the User from the Website.
- PATT Mebel undertakes to provide the highest possible quality of service, but is not responsible for any interruptions or disruptions caused by force majeure or unauthorized action of third parties.
- All Services provided by PATT Mebel through the Website are free of charge.
§5.
Types and scope of services provided by electronic means
- The Company provides the following services through the Website: Providing online access to the entire Website resources.
- The PATT Mebel website is available to users 24 hours a day, 7 days a week.
- The Administrator of the Service undertakes to provide the service continuously, but shall not be liable for any lack of access to the service resulting from reasons beyond his control, and reserves the right to a short technical break in the functioning of the Service in the event of planned, ongoing operation or maintenance of the Service or software used to provide the service.
- The Administrator of the Website reserves the right to periodically suspend the functioning of the Website for an important reason without prior notice to Users.
- Users undertake not to send illegal content within the meaning of art. 8 sect. 3 pt. 2 letter b of the Act on the provision of electronic services while using the Website.
- Users agree to use the Website only in accordance with applicable law, rules of social coexistence and good manners, respecting intellectual property rights.
- The time appropriate for the Patt Mebel Website is the time appropriate for the territory of Poland.
§6.
Personal data
- Patt Mebel processes the collected Personal Data in accordance with current legislation on the protection of personal data, with particular reference to the Act on the provision of electronic services and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (the General Data Protection Regulation) (hereinafter: ‘RODO’). Users’ personal data will be processed in order to provide the Contact service and to ensure continuous access to the Website and to achieve the legitimate interests of Patt Mebel, which are considered in particular the marketing of the administrator’s own products and services.

- The principles of collection, processing and protection of personal data and the use of cookies are set out in the Privacy Policy and in the Cookie Policy placed on the Website at the address:
§7.
Complaint procedure
- The User has the right to make complaints in matters relating to the implementation of electronic services.
- User complaints can be submitted in electronic form to the e-mail address of Patt Mebel galeria@patt.pl or in writing to the address of Patt Mebel.
- A correctly submitted complaint should include at least the following personal data of the user: name, surname, correspondence address (if you want to receive a response to the complaint in writing) or e-mail address (if you want to receive a response to the complaint via e-mail) and the subject of the complaint.
- If the data provided in the complaint need to be supplemented, the Administrator of the Service shall immediately request the User to provide additional information within the specified period.
- Patt Mebel will assess the complaint no later than 14 days from the date of receipt, and in particularly complex cases no later than 30 from the date of receipt. within 30 working days.
- In the event that the complaint cannot be resolved within the period referred to in sect. 5 above, the Administrator will notify the User of this fact, together with the reason for this, by e-mail.
§8.
Final Provisions
- These Terms and Conditions can be changed at any time, especially if it will be necessary to take into account changes made within the services provided electronically by the Website Administrator or in case of change of the applicable law.
- Change of Terms and Conditions comes into force within 7 days from publication on the Website. Patt Mebel will inform Users about changes made to the Terms and Conditions by placing the uniform text of the Terms and Conditions on the Website.
- The works placed on the Website are subject to legal protection in accordance with generally applicable laws, including in particular the Act of 23 April 1964 Civil Code (consolidated text of the Journal of Laws of 2020, item 875), the Act of 4 February 1994. on copyright and related rights (consolidated text in Dz. U. of 2020, item 288), the Act of 30 June 2000 Industrial Property Law (consolidated text in Dz. U. of 2020, item 286 as amended) and the Act of 16 April 1993 on combating unfair competition (consolidated text in Journal of Laws of 2019, item 1010 as amended).
- In matters not regulated by these Terms and Conditions, the provisions of the Act on the provision of electronic services, the Act on Copyright and Related Rights and the Civil Code shall apply.
- In case of a dispute arising under the contract for the provision of services by electronic means, the parties will strive to resolve the matter amicably. The law applicable to resolve any disputes arising under these Terms and Conditions is Polish law.
